8. Aligned: wellbeing and pregnancy disclaimer

Aligned helps you plan and reflect on your daily actions, weekly rhythm, goals and values.

Some Paths include suggestions about exercise, training, rest, nutrition, mental wellbeing, relationships or pregnancy. These are general lifestyle suggestions for personal planning only. They are not medical advice, diagnosis, treatment or therapy, and they are not a substitute for guidance from a doctor, midwife or other qualified professional.

If you are pregnant, injured, unwell, or have a physical or mental-health condition, speak with a qualified healthcare professional before starting or changing any exercise, training, diet or health routine. Follow their advice over anything shown in Aligned.

Choose only actions that are safe and appropriate for you, and adapt or skip any suggestion that is not. Stop any activity that causes pain, dizziness or discomfort, and seek medical help if needed.

9. Your content and conduct

You keep ownership of the content you create in our apps, such as logs, reflections, usernames and profile details. For content that we host, such as WILD usernames and profiles, you give us a non-exclusive, worldwide, royalty-free licence to store, display and process it only as needed to operate the feature, including showing it to other users where the feature is designed to do so.

Do not use our apps to:

• harass, threaten, bully, exploit, impersonate or harm others
• create or share content that is unlawful, hateful, defamatory, infringing, misleading or sexually explicit, or that shows other people without their consent
• use offensive usernames or use someone else’s name or identity
• interfere with our apps, servers, payments, subscriptions or security
• scrape, copy or commercially exploit our content, data, scores or destination information
• break any applicable law, App Store rule or these Terms

We may remove content, reset usernames or profiles, and restrict or suspend access to features if we reasonably believe these Terms have been broken or other users need protection. To report abuse in WILD, email support@sterkvekst.no.

10. Subscriptions, payments and refunds

Our apps may offer subscriptions or one-time purchases, including WILD Pro, NIX Pro, and Shoulder Season, Aligned and Aurora subscription plans. Prices, periods, trials and included features are shown in the app before you buy, and may vary by country and change over time.

All payments are processed by Apple and charged to your Apple ID. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Free trials convert to a paid subscription unless you cancel at least 24 hours before the trial ends. You can manage or cancel subscriptions in your Apple ID settings. Deleting the app does not cancel a subscription.

You can restore purchases from inside each app. Refunds are handled by Apple under Apple’s policies; request them at reportaproblem.apple.com.

If you are a consumer in the EU/EEA, you normally have a 14-day right to withdraw from purchases made at a distance. By starting to use a subscription or digital content immediately after purchase, you agree that its supply begins at once and acknowledge that you lose the right of withdrawal once supply has begun, as permitted by law. This does not affect Apple’s own refund process.

11. Changes to the apps and these Terms

We may add, change or remove features, content, destinations, Paths, prompts, pricing and premium benefits, and we may discontinue an app. If we make a change that materially reduces what you have paid for during an active subscription period, you may contact Apple for a refund in accordance with Apple’s policies and applicable law.

We may update these Terms, for example when we launch new apps or features or when the law changes. The effective date above shows the latest version. Where a change is significant, we will take reasonable steps to let you know. If you continue to use the apps after a change takes effect, you accept the updated Terms.

12. Third-party services

Our apps rely on third-party services such as Apple (App Store, payments, notifications, widgets and MapKit), RevenueCat (subscriptions), Supabase (WILD social features and Aurora forecasts and alerts), PostHog (WILD and Aurora analytics), and public forecast data from MET Norway, the NOAA Space Weather Prediction Center and GFZ Potsdam (Aurora). We are not responsible for outages, errors or changes caused by these services, or for third-party websites, bookings or apps that you open from our apps. Their own terms and privacy policies apply.

13. AI-assisted content

We use AI-assisted tools to help develop our apps and to research, draft, translate and structure some app content, such as destination information, prompts and Path suggestions. We review this content, but it may still contain errors. It is not professional advice.

14. Disclaimers

To the fullest extent permitted by law, our apps and all content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose, availability or non-infringement. We do not guarantee that the apps will be uninterrupted or error-free, or that data stored on your device will not be lost.

We do not guarantee any particular outcome from using our apps, including any change in health, habits, nicotine use, wellbeing, fitness, pregnancy, savings, travel experiences, aurora sightings, relationships or social outcomes. Stats, scores, estimates, forecasts, insights, labels, rankings, suggestions and alerts are for information, awareness, planning or entertainment only.

You use our apps at your own discretion and risk, and you are responsible for your own decisions and actions, both inside and outside the apps.

15. Limitation of liability

To the fullest extent permitted by law, Sterk Vekst AS and its owners, employees, contractors and service providers are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, savings, bookings or travel costs, arising from or related to your use of, or inability to use, our apps or their content.

To the fullest extent permitted by law, our total liability for any claim relating to our apps is limited to the amount you paid for the relevant app or subscription in the 12 months before the claim, or NOK 100 if you paid nothing.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, liability for gross negligence or intentional misconduct, or your mandatory rights as a consumer.

16. Indemnity

To the extent permitted by law, you agree to compensate Sterk Vekst AS for claims, losses and reasonable costs resulting from your breach of these Terms or your misuse of our apps, including content you share. This does not apply where the law does not allow such an obligation for consumers.

17. Suspension and termination

You may stop using our apps at any time by deleting them and cancelling any subscription in your Apple ID settings. We may suspend or end your access to an app or feature if you seriously or repeatedly break these Terms, misuse the service, or put other users or our systems at risk. Sections that by their nature should survive, including sections 3, 9 and 14 to 20, survive termination.

18. Apple-specific terms

If you downloaded an app from Apple’s App Store:

• These Terms are an agreement between you and Sterk Vekst AS only, and not with Apple Inc. (“Apple”). Sterk Vekst, not Apple, is solely responsible for the app and its content.
• Your licence is limited to using the app on Apple-branded products that you own or control, as permitted by the App Store Usage Rules, except that the app may also be used by other accounts in your Family Sharing group or through volume purchasing.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• Sterk Vekst, not Apple, is responsible for handling any claims relating to the app or your use of it, including product liability claims, claims that the app does not meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the app or your use of it infringes their intellectual property rights, Sterk Vekst, not Apple, is responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Where Apple’s Standard Licensed Application End User License Agreement applies to an app, these Terms supplement it. If they conflict, these Terms apply to the extent permitted by Apple’s rules.

19. Governing law and disputes

These Terms are governed by Norwegian law. If you are a consumer, this does not deprive you of the protection of mandatory laws of the country where you live.

Please contact us first so we can try to resolve any problem. Consumers in Norway can also contact the Norwegian Consumer Council (Forbrukerrådet). Disputes will be decided by the Norwegian courts, with the court for the registered office of Sterk Vekst AS as the agreed venue, unless mandatory consumer law gives you the right to bring proceedings in the courts where you live.

20. General

If any part of these Terms is found to be invalid or unenforceable, the rest remains in force. If we do not enforce a right, we have not waived it. You may not transfer your rights under these Terms. We may transfer ours to a company that takes over an app or our business, without reducing your rights. These Terms, together with the Privacy Policy, are the entire agreement between you and us about our apps. If these Terms are translated, the English version prevails.
